Sesom Tours Acknowledgment, Assumption of Risks, Release of Liability, and Indemnity Agreement

Sesom Tours LLC (“Sesom Tours,” “we,” or “us”) is a limited liability company based in Nevada that operates as a tour organizer, offering tours in and around Las Vegas.

The terms “you” and “traveler” pertain to the individual making a booking with Sesom Tours and all accompanying members of their group. By voluntarily participating in our tours, you (and, for minor participants, their parents or guardians) agree to the terms outlined in this Agreement.

**CONTRACT**: It is essential to familiarize yourself with the Terms and Conditions presented here, including all relevant documents and communication from us and our suppliers, as they collectively constitute the binding contract between you and Sesom Tours. Your confirmation of a booking implies acceptance of these Terms and Conditions, acknowledging that you have read and comprehended them. Please be aware that these conditions include waivers of liability, class action waivers, and clauses related to venue selection and notice.

For group bookings, the group leader is responsible for sharing these Terms and Conditions with all members and assumes financial responsibility for the booking. Sesom Tours is not liable for any failure by the group leader to disseminate these terms.

You confirm that (a) you have the legal capacity to enter into this agreement, (b) you are authorized to act on behalf of any individuals you represent, and (c) all information provided by you or your group is accurate.

Any breach of these terms may result in (a) reservation or purchase cancellation, (b) forfeiture of paid amounts, and (c) denial of access to the relevant travel products or services.

Sesom Tours reserves the right to cancel trips or upgrade passengers to pricier tours. In the event of tour cancellation, unused expenses may be refunded.

**COVID-19 RELEASE OF LIABILITY**: By booking a tour, you acknowledge the contagious nature of COVID-19, assuming the risk of exposure or infection for yourself and any accompanying minors. You understand that COVID-19-related uncertainties may lead to tour postponements, cancellations, or itinerary changes with no guaranteed refunds. Sesom Tours encourages the purchase of travel protection coverage, and failure to do so absolves Sesom Tours of liability for resulting losses.

You, on behalf of yourself and any minors, release Sesom Tours from claims arising from COVID-19-related issues, including exposure, infection, closure, and travel restrictions. This release remains effective even after the termination or cancellation of this Contract.

**BOOKING/PAYMENT**: Initiating your travel adventure involves contacting us via email, phone, or our website. Your booking is confirmed upon receipt of the completed registration form. After booking, you will receive your itinerary, invoice, and other essential travel details. Upon processing your trip payment, you will receive a receipt and a checklist for reviewing travel documents. Any errors must be promptly reported, as Sesom Tours is not responsible for document discrepancies.

**CREDIT CARD BOOKINGS**: While we accept major credit cards, improper chargebacks are discouraged. Disputes should be discussed with us first, and we retain the right to dispute improper chargebacks, recover associated costs, and cancel travel reservations linked to such chargebacks.

**FORCE MAJEURE**: You acknowledge the inherent risks of travel, including but not limited to acts of God, terrorism, civil unrest, and natural disasters. Sesom Tours assumes no liability for losses resulting from force majeure events. In such cases, refunds are not guaranteed, though recoverable monies will be refunded without additional charges.

**PHOTOGRAPHIC/VIDEO LIKENESS**: Travelers consent to Sesom Tours publishing trip photographs and/or videos in various media without further consent or compensation. Sesom Tours and its representatives are released from liability regarding the use of such media.

**SMS/EMAIL COMMUNICATION**: By booking or contacting Sesom Tours, you opt in to receive SMS and email communication regarding your tour.

**MINOR PARTICIPATION**: For minor participants, you, as the parent or guardian, warrant the authority to decide on their participation. The terms of this Agreement apply equally to both yourself and your child.

**ENTIRE AGREEMENT & SEVERABILITY**: This agreement, along with any accompanying documents, constitutes the entire agreement, superseding all prior communications. If any provision is deemed invalid, it shall not affect the validity of the remaining provisions.

**CLASS ACTION WAIVER/LIMITATION OF DAMAGES/NOTICE OF CLAIM**: Claims against Sesom Tours are limited to individual capacity, and punitive damages are waived. Notice of claim must be provided within 30 days after the trip or cancellation.

These Terms and Conditions are governed by the laws of the State of Nevada, and any legal action must be brought in Clark County, Nevada. If any provision is found invalid, the remaining provisions remain enforceable.
